Use this sequence before travel, payment or signature; it distinguishes legal advice from translation, tax advice, technical property inspection and banking approval, which may involve other professionals or institutions.

How does a power of attorney work when you are overseas?

When you are in Turkey, a Turkish notary can prepare or authenticate the document. If you do not understand Turkish sufficiently, arrange a sworn interpreter for the notarial appointment so that the document and its legal effect are explained before signature. Interpreter availability and notary requirements must be confirmed in advance; an English explanation does not replace the notary’s formal process.

When you are abroad, common routes are execution at a Turkish consulate or before a local notary followed by the authentication needed for use in Turkey. Türkiye is a party to the 1961 Hague Apostille Convention, but whether a particular document can use an apostille depends on the issuing country, document type and receiving authority. The apostilled document may then need a sworn Turkish translation and notarial certification. The receiving Tapu office, court, bank or other institution can apply document-specific requirements.

How are fees, tax numbers and bank transfers handled?

A lawyer’s fee is separate from notary charges, translation, apostille, courier, court, expert, registry and other public expenses unless the written engagement expressly says otherwise. A Turkish tax number, bank account or payment receipt does not prove that a lawyer is registered; use the official Baro registry separately.

How will communication work across a time difference?

Confirm the returned record directly with Muğla Barosu or TBB before relying on a registration number or status.

Article 36 of Attorneys Act No. 1136 prohibits disclosure of matters learned through professional duties. It also makes a lawyer’s testimony about those matters subject to the client’s consent, while preserving the lawyer’s right to refuse to testify.
