Çalış has foreign homeowners, tenants, retirees, seasonal residents and families using apartments or houses during different parts of the year. Common legal work includes purchases and sales, apartment title and building records, residence-permit files, rent or eviction questions, and estates after an owner dies. The document, address, parties and deadline set the route, not the seaside location alone.

Av. Yanatma works with the exact Turkish address on the tapu, tenancy agreement or residence record. A resort name, street address and official mahalle entry may not be identical. His property-law service covers title, contract and transfer questions before a transaction becomes difficult to unwind.

What should a foreigner check before buying a Çalış apartment?

A viewing and clean-looking apartment are not a complete legal check. Request the current tapu record, inspect ownership shares and annotations, confirm the seller can transfer the unit, and compare the independent-unit number with the approved project and contract.

An iskan is the Yapı Kullanma İzin Belgesi issued after the competent authority checks completion against the construction permit and technical requirements; the title deed is not an iskan. Unlicensed or permit-inconsistent work can lead to sealing, an order to remedy or demolition and an administrative fine under İmar Kanunu Articles 32 and 42. Check enclosed balconies, changed common space and works absent from the approved project.

Turkish coastal law treats the shore and beach strip as a public-use area under State control. A private title does not authorise a seawall, private beach, exclusive access or construction near the shore; check the coastal line, approved plan and protected-area status for the parcel.

How can a year-round Çalış resident manage a residence permit?

A resident should identify the correct permit category, keep address and identity records consistent, and submit through the current Göç İdaresi process. Under Law 6458, a renewal application may be made during the 60 days before expiry and must be made before the existing permit expires. Treat an expiring card as urgent.

Use e-İkamet, the Göç İdaresi appointment system or YİMER 157 to establish the current location and document list; a Çalış address does not itself identify the appointment office. Av. Yanatma’s residence-permit service explains how to prepare the legal file.

How do rent increases and tenancy disputes work in Çalış?

For an ordinary residential renewal, TBK Article 344 uses the change in the twelve-month average consumer-price index as the statutory ceiling for the agreed increase. The temporary 25% residential cap applied to renewal periods from 2 July 2023 through 1 July 2024. Later renewals follow the ordinary statutory rule unless a new amendment applies; five-year re-determination, lease type and renewal date can alter the analysis.

Most tenancy disputes have required mandatory mediation before court proceedings since 1 September 2023, with statutory exceptions for certain enforcement-based evictions. Check notice wording, service date, payment records, lease duration and proposed eviction ground before sending a demand. The tenancy and eviction service distinguishes a contractual disagreement, enforcement step, mediation file and court claim.

An owner who wants to let a Çalış apartment to holidaymakers must also look at Law 7464. A letting to the same user for 100 days or less generally needs a Tourism-Purpose Rental Permit before it is advertised, and in an apartment block the other owners must generally agree unanimously. Tax registration and the building’s own rules still apply once a permit is issued.

What happens when a foreign apartment owner dies?

Inheritance work may involve tapu, bank, will, family records, taxes and foreign documents. Secure death and identity records, title information and originals, noting the issuing country for each foreign document.

A Turkish notary cannot issue a succession certificate requested by foreigners under Notaries Law Article 71/B; the matter should go to the competent Sulh Hukuk Mahkemesi. An apostille may matter, but acceptance depends on the issuing country, document and receiving authority. The inheritance and wills service explains the Turkish procedure without assuming foreign probate transfers Turkish property by itself.

Which courthouse, Tapu office and migration route serve Çalış?

Fethiye Courthouse is the local courthouse for ordinary Fethiye-area proceedings described in the Justice Commission’s 2025 report. The report lists civil, criminal, family, Sulh Hukuk, enforcement, labour and cadastre courts, and gives the main address as Akarca Mahallesi, Mustafa Kemal Bulvarı No:210, Fethiye/Muğla. The claim determines the chamber and filing venue.

For a Çalış apartment, match the parcel to the Tapu Müdürlüğü returned by TKGM or WebTapu. Public map listings place Fethiye Tapu and Kadastro offices around 677 Sk. No:10A and 678 Sk.; check the current unit and entrance with TKGM before an appointment. The TKGM FAQ is safer than an old map pin.

For immigration, let e-İkamet, the official appointment system or YİMER 157 return the current Muğla/Fethiye location. It may not be a permanent district office, so follow the result shown by the official system rather than a directory address.

How does Av. Yanatma work with clients in Çalış?

Av. Seyfullah Yanatma’s office at Akarca Mah. 878. Sk. No:55/1/2, 48300 Fethiye/Muğla is a short drive from Çalış beach. He works in English and Turkish, and Çalış clients can send contracts, title records, permits, notices or inheritance papers before a meeting.

He identifies the authority, checks Turkish documents, calculates date-sensitive steps and explains whether a notary, mediator, Tapu, migration appointment or court filing is needed. If attendance or a power of attorney is required, the representation method is agreed first; a local visit can be considered when the file needs it.

For a Çalış property, residence, inheritance or tenancy question, the contact page provides the route to send the location and key documents for an initial issue assessment.

Frequently asked questions

Can a foreign resident in Çalış renew a Turkish residence permit?

A renewal application may be filed during the 60 days before the current permit expires and must be filed before expiry. Use Göç İdaresi's current e-İkamet and appointment systems, prepare the address and other records requested for the permit type, and confirm the responsible office through YİMER 157 because locations can change.

Is a title deed enough when buying an apartment in Çalış?

No. Compare the tapu with the approved project and independent-unit details, check mortgages and annotations, verify the seller's authority, and request the building permit and iskan (habitation certificate). A shore-side or short-term rental plan also needs separate coastal, zoning, condominium and tourism-rental review.

How is foreign-element inheritance handled in Çalış?

A Turkish notary cannot issue a succession certificate requested by foreigners. Take a foreign-element inheritance to the competent Sulh Hukuk Mahkemesi, with death, family, will, identity, title and financial records prepared. Foreign public documents may need an apostille or another form of acceptance, depending on the issuing country and use.

What rule limits a rent increase for a Çalış home?

For an ordinary residential renewal, the agreed increase is limited by the previous year's twelve-month CPI average under Turkish Code of Obligations Article 344. The temporary 25% residential cap covered renewals from 2 July 2023 through 1 July 2024; later renewals return to the ordinary rule unless a later amendment applies. Check the lease and renewal date.

Must tenancy disputes in Çalış go to mediation first?

Most disputes arising from a residential or workplace tenancy must pass through mandatory mediation before court action, subject to statutory exceptions including certain enforcement-based evictions. Notice, service, lease term, payment history and the proposed claim determine the route. A failed mediation creates the record for any subsequent eligible claim; it does not decide who is right.

Which courthouse serves foreign residents in Çalış?

Fethiye Courthouse is the local courthouse for the ordinary Fethiye-area civil, family, criminal, enforcement, labour and cadastre proceedings listed in the current justice report. Its main building is at Akarca Mahallesi, Mustafa Kemal Bulvarı No:210, Fethiye/Muğla. The claim and parties determine the chamber and venue.

Where should I check the land registry office for a Çalış apartment?

Use TKGM and WebTapu to identify the Tapu Müdürlüğü competent for the apartment's parcel. Public listings place Fethiye Tapu and Kadastro offices around 677 Sk. No:10A and 678 Sk.; ask TKGM for the current unit, entrance, appointment and document list before attending or arranging a transfer.
